Civil Litigation

Fonseca Law offer a wide range of litigation advice in relation to civil disputes. Whether you are an individual or a business our solicitors can advise you and deal with litigation matters on your behalf from the commencement of a dispute throughout any court proceedings to the settlement of the matter. We have experience in dealing with a wide range of matters from personal injury and negligence claims to contract and consumer disputes, to disputes over land and probate issues, and to possession proceedings.

We have acted in proceedings in the County Court, Mercantile Court, Technology and Construction Court and the Chancery and Queen’s Bench Divisions of the High Court. There will also be occasions where proceedings are not appropriate and in those circumstances we can offer our experience and advice regarding alternative dispute resolution and expert-based mediation. We are skilled negotiators and we will always encourage settlement prior to final court hearings where possible and appropriate, to minimise costs payable by you.

Past Cases

Instructions were provided by a construction firm in a claim before the Technology and Construction Court. The issue in the case was unpaid consideration on a large residential development claim. The case was settled on favourable terms within the trial period.

We have acted for a sub contractor in a claim against major plant supplier. The issues in the case were contractual including an alleged breach of warranty. The claim was settled following the preparation of pleadings and exchange of witness evidence.

Having been instructed by a commercial developer we were able to obtain an equitable declaration as to a right of way. The declaration was obtained by agreement following the preparation of evidence and mediation. The granting of the declaration allowed the development to proceed to completion.

We have provided advice to the managing director of a company to defend a claim brought by purchasers of the company regarding a breach of contract arising from the sale.
