What are my product liability rights?
We are all consumers of many different products and services, from hair dye to chocolate to computers. You have a right to expect that the products you pay for are safe to use, and that you are properly warned about any dangers they may present.
The 1987 Consumer Act makes manufacturers and suppliers responsible for personal injuries resulting from faulty or hazardous items. This covers everything from electronic goods and gadgets, to food and furniture, to medical devices and treatments.
What can I claim for?
There are four main types of claim:
- Manufacturing defect - if a product is contaminated or tainted in the manufacturing process, or has poor quality materials or shoddy workmanship that lead to injury. For example, food poisoning due to a failure of quality procedures in making a food product.
- Design defect - if a product is designed in a way that is inherently dangerous or likely to injury, for example, a pushchair that traps a hand or finger due to bad design.
- Failure to warn - if injury arises out of insufficient warnings on the actual product that there is a danger. Claims made in advertising or promotional materials can lead to claims for negligence.
- Failure to recall - if a company fails to respond promptly and appropriately when they discover a defect, then they become liable for resulting injury claims.
